Fireside Chat with PIP Experts Sergio Carro and Craig Goldstein

In 2013, the NJ Department of Banking and Insurance (DOBI) adopted new PIP medical fee schedules which were affirmed by the Appellate Division in 2015 after being subject to a legal challenge. The fee schedules were set to approximate 130% of Medicare payments (with adjustments), with some treatments not subject to the fee schedule because there was not enough data to set a fee.

Fast forward to 2023 and the PIP MFS remains the same without the statutory required biennial review. However, DOBI has retained FAIR Health to review and make recommendations to revise the PIP MFS, a process that will include Rule Proposals and public input.

  • What can we expect from this long-awaited review and the rule proposal process?
  • What are the obvious reimbursement revisions, possible inclusions of underrepresented areas of treatment?
  • What’s necessary to curb fraud, abuse and overutilization?
  • What are the expectations of carriers and providers?
  • What’s germane to the medical spend? The amount of PIP coverage! Is there a valid reason to raise the minimum PIP limit from $15K to $50K or $250K?

These and various other issues will be discussed during this conversation with two of New Jersey’s auto PIP MFS experts.

Regulatory, Legal and Legislative Forecasting: what does the future hold for NJ’s P&C insurance industry?

As we continue to monitor the impact of three private passenger auto laws that collectively will have an adverse impact on premiums and litigation costs (the change in standards for bad faith UM/UIM claims; the early disclosure of liability limits in a dispute; and the increase in minimum liability coverage limits), what are we seeing in the courts and what else can we expect from NJ’s legislature and regulator? On deck are bills that will increase the minimum liability limits for commercial vehicles, raise the minimum PIP limit, and restrict various underwriting variables. Plus, the NJ Department of Banking & Insurance is expected to propose revisions to the PIP Medical Fee Schedule.
