What’s new in NJ’s Auto Insurance Market? Four laws.

Since 2019, four laws have been enacted affecting New Jersey’s private passenger auto market. Collectively, these statutes present clarifications, create new ambiguities, generate litigation, and encourage critical ways of rethinking claims disputes. This seminar will explore the implementation and interplay of these laws and highlight the challenges that they pose to claims specialists, underwriters, defense counsel and consumers.

  • Overturning the Haines v. Taft decision: permitting injured automobile accident plaintiffs to recover unreimbursed medical expenses. How do insurers prepare to meet these claims at trial?

  • Disclosure of Limits for both private passenger and commercial auto claims. What are the pros and cons for insurers and the claimants?

  • The Insurance Fair Conduct Act (IFCA). What are the nascent patterns of the new bad faith standard? Are typical UM/UIM claims becoming more complicated? How are judges handling these cases?

  • Increase of minimum liability limits. Does increasing the minimum limits truly benefit the consumer?
