Fireside Chat: Senate Commerce Committee Chairman Joseph Lagana
Senator Joseph "Joe" Lagana (D-Bergen County) was named Chairman of the Commerce Committee this past January following the election of Nellie Pou to Congress. Throughout his legislative career, Chairman Lagana has been deeply involved in legislation impacting the insurance industry. In his professional life, he is an attorney who previously worked on insurance defense, including Bad Faith defense, and today works on PIP arbitration for Cleary, Giacobbe, Alfieri & Jacobs. The Commerce Committee oversees a wide range of issues and is the primary reference committee for all Property Casualty Insurance bills, except for Workers Compensation. The Chairman himself has sponsored legislation governing minimum PIP requirements, improving the tools for fighting insurance fraud, and has advocated directly on the industry’s behalf both in caucus and at the Department. How a Proposed Disparate Impact Rule Will Affect the Industry as Underwriters & Employers
Last spring, the Division of Civil Rights proposed a sweeping disparate impact rule which would affect every entity doing business in the State of New Jersey. The proposed rule significantly alters NJ’s Law Against Discrimination (LAD) and departs from established state and federal disparate impact liability standards that apply to employment, contracting and housing. Crucially, in addition to potentially exposing the industry to lawsuits as employers and business entities, the proposal creates specific liability for disparate impact discrimination by home and renters’ insurance underwriters, including exposure to the LAD’s private right of action provision. The insurance industry has taken a leadership role in pushing back on this unprecedented encroachment on the exclusive jurisdiction of DOBI, especially since the proposal would require insurers to collect data that they currently are prohibited from collecting to defend their underwriting practices.
