The NJ Supreme Court recently ruled on two distinct cases that reinforce key statutory boundaries under New Jersey insurance law, affirming interpretations that protect policy limits and maintain the Superior Court's jurisdiction over complex fraud claims. In Chiaccheri v. Zurich, the Court addressed two questions posed to it by the Third Circuit Court of Appeals regarding maximum UIM coverage as the limit selected by the named insured, not the general liability limit. In Allstate v. CCMC, the Court considered whether civil claims alleging patterns of insurance fraud under the Insurance Fraud Prevention Act (IFPA) and New Jersey RICO must be arbitrated under No-Fault / Automobile Insurance Cost Reduction Act (AICRA) or tried in Superior Court.
